Regulation 18B(5) Waste Avoidance and Resource Recovery Regulations 2008

If you are a liable person under regulation 18B(1) of the Waste Avoidance and Resource Recovery Regulations 2008 (WARR Regulations) you are required to inform the Chief Executive Officer (CEO) of Department of Water and Environmental Regulation (DWER) in an approved form that you are a liable person for the purposes of regulation 18B(1) and the type of liable person you are as required under regulation 18B(5). If you do not, by virtue of regulation 18E(1) of the WARR Regulations you may commit an offence for failing to inform the CEO of DWER of your status as a liable person.
Penalty: a maximum fine of $10 000.

You must also ensure that any information you give to the CEO of DWER about your status as a liable person is not to your knowledge false or misleading in a material particular. If you do not, pursuant to section 112 of the Environmental Protection Act 1986 as applied to the Waste Avoidance and Resource Recovery Act 2007 (WARR Act) and the WARR Regulations by section 93(a) of the WARR Act, you may commit an offence of providing information that to your knowledge is false or misleading in a material particular.
Penalty: a maximum fine of $50 000.
